THESE APPLICATION TERMS AND CONDITIONS (TERMS) CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS, PRIVACY AND PERSONAL INFORMATION.  PLEASE READ THE APPLICATION AND ACCOMPANYING PRIVACY STATEMENT CAREFULLY.   

I, the applicant named in this Participant Application, agree that in consideration for Lune Media Pty Ltd (the “Producer”)’s labour and expense in making arrangements relating to my Participant Application (“Application”) for the television program entitled “THE GREAT AUSTRALIAN FOOD CON” (also referred to as the “Program”) and the opportunity provided to me to potentially appear in or in association with the Program, I hereby consent to the provision of my personal information in this Application on the terms and conditions below:

1.    The Producer has no obligation to interview me, and/or select me as a participant for the Program. 

2.    If I participate in any stage of the production of the Program then prior to and as a condition for my participation, I understand and agree that I will execute all waivers, release agreements and/or a separate Participant Release as required by the Producer and the Program’s broadcaster (the “Broadcaster”) and any of its licensees, successors or assigns.
     
 

3.    Even if I am selected as a participant, the Producer has no obligation to record my involvement in the Program and the Broadcaster has no obligation to broadcast my involvement in it. 

4.    I have not and will not enter into any commercial or other sponsorship agreement or arrangement with any person, firm or company in respect of any appearance I might make in the Program. 

5.    I agree not to disclose to any third party (other than my professional advisors) any information relating to the Program or the affairs of the Producer (or any assigned company) or any broadcaster of the Program, which may come to my knowledge during or in connection with my participation in the Program, including during the application process.

6.    I agree that I will not publicise or discuss with any third party without prior written consent from the Producer, any information relating to the Program, any appearance or proposed appearance by me or others related to my application in the Program, any of the production team or any participants in the Program nor any other information which may come to my attention relating to the Broadcaster or the Producer or otherwise connected to the Program save for such information which is already public knowledge. This includes uploading information or photographs to blogs or social networking sites, including to Facebook, Instagram, TikTok, X (Twitter), etc. Should I be contacted by a member of the press at any time I agree to refer them to the Producer or such person as the Producer may nominate.

7.    By submitting this application:

a.    I hereby consent to the recording, editing, use and reuse by the Producer, Broadcaster, and any of their respective licensees, successors, assignees, parents, subsidiaries, or affiliated entities, and each of their respective employees, agents, representatives, officers and directors (collectively “Releasees”) throughout all stages of the Application of (i) my voice, actions, likeness, name, appearances, biographical material (collectively “Likeness”) and/or (ii) any information contained in, derived from or obtained in connection with my Application and  in any materials submitted by me or a third party in connection with the Application (which includes any video or photograph submitted and any personal information as defined in the Privacy Act 1988 (Cth) (the Act) (“Personal Information”, which I understand may include my medical history) (collectively, the “Materials”) as edited, altered, or modified by the Producer or by any of the other Releasees, in any and all media now known or hereafter devised, throughout the universe, in perpetuity in connection with the Program.

b.    I hereby consent to be recorded throughout all stages of the Application and further agree that the Producer exclusively owns all right, title, and interest (including, all copyrights) in and to any and all recordings of me made by the Releasees for the purpose of the Program, including the right to edit, alter or modify such recordings and to use the same, including for the purposes of incorporation into the Program, in any and all media now known or hereafter devised throughout the universe, in perpetuity.

c.   I further agree that if as part of my application I provide the Producer any link to content existing on a social media website (“Online Materials”), I grant the Producer an irrevocable, royalty free and non-exclusive licence for the Producer and anyone authorised by the Producer to use and exploit all or part of the Online Materials in and in connection with the Program, including the right to edit, alter or modify the Online Materials for the purpose of the Program, in any and all media now known or hereafter devised throughout the universe, in perpetuity. 

d.    Without limiting the foregoing, I hereby grant the Producer a non-exclusive licence to the Materials such that the Producer shall be entitled to use and exploit, and license others to use and exploit the Likeness and the Materials by all means and in all media and formats whether now known or hereafter invented throughout the universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity. Furthermore, I irrevocably grant all consents and waivers (to the extent permissible at law) necessary to enable the Producer (and persons authorised by the Producer) to make fullest use of the Program, the Likeness and the Materials without restriction.

e.    I warrant that I own all right, title and interest to the Materials or I have received the third-party permissions required at law to use the Materials in accordance with this agreement, and hereby indemnify the Producer of all liability arising from such uses.

f.    I will, at the request of the Producer, do everything necessary, including execute any documents, to give effect to this Agreement and the transactions contemplated by it and cause third parties to do the same.

8.    Information and Privacy

The Producer deals with the collection, security, quality, use and disclosure of personal information in accordance with the Privacy Act 1988 (Cth) (“the Act”) and the Privacy Statement below. 

 Privacy Authorisation and Consent

a.    I hereby authorise the Producer and any person designated by the Producer to investigate, access and collect information about me, about any of the statements made by me in my application, this Agreement, any supporting documents and any other documents that I have signed or provided or do sign or provide in connection with my application to be selected as a participant in the Program, or any other written or oral statements I make in connection with my application (and whether by on-line submission or disclosure, or otherwise) . I irrevocably authorise the Producer and any person or entity designated by the Producer to secure information from my associates, friends, family members, health professionals and any references I have provided, and I irrevocably authorise such parties to provide information concerning me providing such provision of information complies with all relevant laws. I agree to provide the Producer with any specific authority to obtain information about me from government agencies, medical providers, employers and other organisations or providers relevant to my application for the Program, and will sign a written authority if required. I hereby unconditionally and irrevocably release and forever discharge the Producer, the persons or entities designated by the Producer, and all such parties and persons from any and all liabilities arising out of or in connection with any such enquiries. I specifically authorise investigation of my criminal records unless prohibited by law. I acknowledge and agree that any such information obtained by the Producer or by any person or entity designated by the Producer pursuant to this paragraph or otherwise may be used for purposes of selecting participants in the Program or other programs, internal administrative purposes concerning the demographic and performance of individuals interested in appearing on TV programs, and otherwise in connection with the Program. 

b.    I hereby authorise an appropriately qualified person or entity as designated by the Producer to conduct psychological examinations of me as required by the Producer. I further authorise the individuals conducting such examinations of me to disclose to the Producer and their representatives all information about me obtained in connection with such examinations, and authorise Producer to utilise such information in selecting participants for the Program.

c.    Without limiting the foregoing, I authorise and consent to the use of Personal Information (which may include “sensitive information” as defined in the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth)) given to the Producer or collected by the Producer under the terms of this agreement in determining my suitability for the Program and to the use of such information in researching and producing the content of the Program and other programs (including but not limited to content related to my background and participation in the Program) and to the communication of such information to third parties, including but not limited to the general public through broadcasts of the Program and otherwise in accordance with the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth), and also the Producer’s Privacy Policy as may be amended from time to time. I agree that there will be no restrictions on the use of Personal Information relating to me that is contained in the recording of the Program, and the information provided by me to the Producer may also be disclosed to:
 

•    the Producer’s related bodies corporate in Australia and overseas;
 

•    any Program prize supplier or sponsor who may use the personal information at their discretion;
 

•    television networks in Australia and overseas and their related bodies corporate;
 

•    an audience when the Program is broadcast or otherwise exhibited.

PRIVACY STATEMENT
 

Lune Media Pty Ltd (“Lune”, “us”, “our”, “ours” “we”) collects, secures, holds, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth) (the “Act”) and the Australian Privacy Principles (the “APPs”).  This Privacy Statement sets out how we collect, use, store and disclose your personal information, and your rights in relation to that information and should be read in conjunction with our Privacy Policy (accessible at https://www.lunemedia.com.au/privacypolicy). You acknowledge and agree that your participation as an applicant, at an audition or as a contestant or contributor in a Lune Program (as defined below) is subject to the following.
 

Collection and use of personal information
Information (including personal information as described in the Act) provided by you is collected for the purpose of considering your inclusion as a contestant on a television program to be made by Lune with the working title THE GREAT AUSTRALIAN FOOD CON (“the Program”). Information supplied by you must be correct, particularly your full and correct name. If you have failed to provide accurate information, Lune may refuse to process your application and decline to allow you to appear on the Program.

In addition, if you participate in the Program, you agree that there will be no restrictions on the use of personal information relating to you that is contained in the recording of the Program (the “Program Tapes”).

Some information you provide to Lune may constitute “sensitive information” (as defined in the Act) such as your medical history, philosophical beliefs or racial or ethnic origin. Such information may also be collected and used by Lune in accordance with the provisions of this Privacy Statement. We will always seek your consent before we collect your sensitive information. 
 

Disclosure of personal information 
We may disclose personal information that you provide to us to:

•    our related bodies corporate in Australia and overseas;

•    any third party that is financing the Program (“Funder”) and you acknowledge and agree that the Funder may use the personal information for their own marketing and promotion purposes at their own discretion;

•    television networks and their related bodies corporate who acquire our programs for broadcast and other forms of transmission in Australia and overseas; and

•    a viewing audience when the Program tapes and content are broadcast or otherwise exhibited or communicated to the public.
  

Storage of personal information held by Lune
If you are selected to participate in the Program, we will retain your personal information for as long as it is reasonably necessary for the purposes of the Program, for example, for as long as the Program is available for viewing to the public.

If you are not selected to participate in the Program, Lune may use your personal information to consider you for, and to contact you regarding your interest in appearing or participating in other Lune programs. 

We take reasonable care to protect your personal information from misuse, loss, unauthorised access, unauthorised modification or unauthorised disclosure. We implement appropriate and up to date security measures to protect your personal information.

Lune will destroy personal information it no longer needs or requires in a secure manner. 

Access to and correction of personal information held by Lune
You have the right to request access to personal information held by Lune if the personal information held by Lune is inaccurate, you have the right to request it to be updated. You must include details of your identity and the date and circumstances of disclosure of your personal information to Lune when you contact us.
